Please read these Terms and Conditions carefully before using the palmdesertasphaltpaving.com website (the "Site") or engaging Palm Desert Asphalt Paving ("we," "us," or "our") for any services. By accessing the Site or requesting a service from us, you agree to be bound by these terms.
By using this Site or entering into a service agreement with Palm Desert Asphalt Paving, you confirm that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you are acting on behalf of a business or property owner, you represent that you have the authority to bind that party to these terms.
Palm Desert Asphalt Paving provides asphalt paving, sealcoating, striping, repair, and related services to residential and commercial customers in the Coachella Valley,CA. Services are performed on-site at the customer's property following a written agreement between the parties.
The Site provides information about our services and allows customers to submit estimate requests. Submission of a request form does not constitute a binding agreement. A binding agreement is only formed when both parties have signed a written service contract or work order.
All estimates provided by Palm Desert Asphalt Paving are based on information available at the time of assessment. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Prices may be subject to change if site conditions differ materially from those observed during the estimate, if the scope of work changes, or if material costs increase significantly between the estimate and project start date.
Any changes to the agreed scope of work must be documented in a written change order signed by both parties before additional work begins. Verbal agreements to change the scope are not binding.
Project scheduling is confirmed in writing by both parties. We reserve the right to reschedule work due to weather conditions, equipment availability, or other circumstances outside our control. We will notify you as promptly as possible if a scheduled date needs to change.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a cancellation fee as specified in your service agreement, particularly where materials have already been ordered or crew time has been committed.
Work postponed or cancelled by either party due to weather or acts outside either party's control will be rescheduled at no penalty.
Payment terms are specified in your written service agreement. Unless otherwise agreed in writing, payment is due upon completion of work. For larger projects, a deposit may be required before work begins, as stated in the written agreement.
Invoices not paid within 30 days of the due date may be subject to a late fee as specified in the service agreement. Palm Desert Asphalt Paving reserves the right to suspend or terminate services if payment is not received in accordance with the agreed terms.
In the event of non-payment, you agree to reimburse Palm Desert Asphalt Paving for reasonable costs of collection, including attorney fees, to the extent permitted by California law.
You are responsible for ensuring that the work area is accessible on the scheduled date. This includes clearing vehicles, equipment, furniture, and other items from the work area and providing safe access to the site. Delays or additional costs caused by inaccessible work areas may be billed to you.
If your property is governed by a homeowners association, you are responsible for obtaining any required HOA approvals before work begins. Palm Desert Asphalt Paving is not responsible for work that must be removed, redone, or modified due to missing HOA approvals obtained after the fact.
Any warranty on workmanship or materials will be specified in your written service agreement. Unless expressly stated in writing, no implied warranties are made. Warranty coverage does not extend to damage caused by factors outside our control, including vehicle fluids such as oil or gasoline, heavy equipment traffic beyond the load specifications for residential paving, flooding, tree root intrusion, or failure of the underlying subgrade due to soil settlement or conditions not disclosed at the time of estimate.
The Site content, including service descriptions and informational articles, is provided for general informational purposes only and does not constitute a warranty or guarantee of results.
To the maximum extent permitted by applicable law, Palm Desert Asphalt Paving is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services provided or the use of this Site, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a service engagement is limited to the amount actually paid by you for the specific services giving rise to the claim. This limitation applies to the fullest extent permitted by law.
You agree to use this Site only for lawful purposes. You may not use the Site to transmit harmful, misleading, or unlawful content, to attempt to gain unauthorized access to any system or data, or to interfere with the normal operation of the Site.
All content on the Site, including text, images, and branding, is the property of Palm Desert Asphalt Paving and may not be reproduced or distributed without written permission.
If a dispute arises between you and Palm Desert Asphalt Paving, we encourage you to contact us directly first so we can attempt to resolve the matter informally.
If an informal resolution is not reached, any dispute arising out of or relating to these Terms or any service agreement shall be submitted to binding arbitration under the rules of the American Arbitration Association, unless both parties agree in writing to a different resolution process. Arbitration will take place in Palm Desert, California. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the courts of Riverside County, California.
We reserve the right to update these Terms and Conditions at any time. When we make changes, we will update the effective date at the top of this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
